Effective Date: January 1, 2026. Applies to rohnertparkconcrete.com and services provided by Rohnert Park Concrete.
By accessing or using the website at rohnertparkconcrete.com, requesting an estimate, or hiring Rohnert Park Concrete to perform any work, you agree to be bound by these terms and conditions. If you do not agree with any part of these terms, do not use our website or services. These terms apply to all visitors, customers, and anyone who requests or receives services from us.
Rohnert Park Concrete provides concrete contracting services to residential and commercial customers in Rohnert Park, CA, and surrounding areas. Services include, but are not limited to, concrete driveway installation and replacement, patio construction, sidewalk building, slab foundations, retaining walls, decorative and stamped concrete, pool decks, steps, footings, and concrete cutting. The specific scope of work for any project is defined in a written proposal or contract provided before work begins. Services rendered are subject to the terms set forth in that written agreement and these terms and conditions.
All estimates provided by Rohnert Park Concrete are based on information available at the time of the on-site visit and are valid for 30 days from the date of issuance unless otherwise stated in writing. Estimates are not binding contracts. A project is confirmed only when a written proposal or contract is signed by both parties.
Pricing may change if site conditions differ materially from what was observed during the estimate, if the scope of work changes at the customer's request after signing, or if material costs change significantly due to supply chain conditions outside our control. We will notify you in writing before proceeding with any work that would result in a price increase, and we will not proceed without your written authorization.
Any verbal representations about price, timeline, or scope made outside of a written agreement are not binding. All modifications to a signed contract must be made in writing and signed by both parties.
Project start dates are scheduled upon contract signing and are subject to crew availability, material lead times, permit processing times, and weather conditions. Concrete cannot be poured in rain or freezing temperatures. We reserve the right to delay a pour date due to weather without penalty or liability to the customer.
If you need to cancel or postpone a scheduled project, please notify us as soon as possible. Cancellations made more than 5 business days before the scheduled start date with no materials ordered will incur no cancellation fee. If materials have been ordered or a permit has been pulled, you may be responsible for actual costs incurred up to the point of cancellation.
We reserve the right to reschedule or cancel a project if we are unable to obtain required permits, if site conditions present unforeseen safety concerns, or if the customer fails to fulfill their obligations under the signed contract (such as clearing the work area or making a required deposit).
Payment terms are specified in the written contract for each project. Typical arrangements include a deposit at contract signing and final payment upon project completion. Specific percentages and payment milestones will be stated in your written agreement.
Invoices are due on the date specified in the contract. Accounts not paid within 15 days of the due date may be subject to a late fee of 1.5% per month on the outstanding balance, to the maximum extent permitted by California law. Rohnert Park Concrete reserves the right to suspend or terminate services on any project where payment obligations are not met.
If a payment dispute arises, please contact us in writing at the email address below within 10 days of receiving an invoice. We will work in good faith to resolve any legitimate billing concerns promptly.
Rohnert Park Concrete will obtain all permits required by the City of Rohnert Park or other applicable jurisdictions for work we perform, unless otherwise agreed in writing. Permit fees are the responsibility of the customer and will be itemized in the written proposal. We will not begin any permitted work until the required permit is issued.
The customer is responsible for disclosing any known site conditions that could affect the work, including buried utilities, easements, HOA restrictions, or prior unpermitted work. Failure to disclose such conditions may result in additional costs or project delays for which Rohnert Park Concrete is not responsible.
To the maximum extent permitted by applicable law, Rohnert Park Concrete shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the services we provide or our website, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or related to a specific project shall not exceed the total amount paid by the customer for that project. This limitation applies regardless of the theory of liability, whether in contract, tort, negligence, or otherwise.
We are not liable for damage caused by pre-existing site conditions that were not disclosed to us, for damage caused by underground utilities that were not properly marked before work began, or for natural soil movement outside of normal seasonal variation in the region.
Rohnert Park Concrete warrants that all work performed will be completed in a workmanlike manner consistent with standard industry practices for the Rohnert Park area. If a defect traceable to our workmanship is identified within one year of project completion, we will return to assess and correct it at no additional charge to the customer.
This workmanship warranty does not cover: normal concrete cracking due to curing, hairline cracks that do not affect structural integrity, surface discoloration caused by weather exposure or chemical contact, damage caused by tree roots or third parties, or problems arising from undisclosed site conditions.
Concrete is a natural material that will develop minor surface variations and hairline cracks over time as part of normal curing and seasonal movement. These are not defects. Any concern about finished work should be raised in writing within 30 days of project completion.

We prefer to resolve any disputes directly. If you have a concern about our services, contact us in writing at the email address below. We will respond within 5 business days and make a good-faith effort to reach a resolution.
If direct resolution is not possible, both parties agree to attempt mediation through a mutually agreed-upon mediator in Sonoma County, California, before pursuing any legal action. The cost of mediation will be split equally between the parties unless the mediator determines otherwise.
Any dispute that cannot be resolved through direct discussion or mediation shall be subject to binding arbitration in accordance with the rules of the American Arbitration Association, with the arbitration conducted in Sonoma County, California. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
These terms and conditions, and any disputes arising from or related to them, shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings not subject to the arbitration clause above shall be brought exclusively in the state or federal courts located in Sonoma County, California.
